Guide for exporting biological resources outside Sabah

What you should know before applying

  • Please note that you can only submit your Export Licence applications after your Access Licence has been approved.   However, the approval of your Access Licence does not guarantee that your Export Licence application will be approved. 
  • Since obtaining a letter of support, consent, or permission may involve time and specific procedures from various government departments, agencies, and organisations, you are advised to make prior arrangements to secure the necessary documents as soon as you decide to apply.
  • Users are required to utilise existing facilities and expertise within Sabah. If this is not feasible, a clear justification for the need to export must be provided.
  • Provide detailed research analyses; incomplete applications will not be accepted and will be rejected.
  • State the number of consignments to be shipped within one year; licence fees are based on this number. 
  • After receiving the Export Licence, your Local Collaborator must verify the materials, complete the Material Transfer Declaration form, and submit it to SaBC before shipment. 
  • Export of biological resources shall be made in accordance with other written laws and regulations enforced in Sabah.

How to Apply?

1.  If necessary, please contact us for advice. 

2. Prepare all supporting documents:

  •  Letter of support from your local collaborator. Your local collaborator must mention the following matters:
  1. He/she supports your intention to export the biological resources or associated relevant knowledge out of Sabah;
  2. Justification on why the research could not be conducted in Sabah; and
  3. List of samples/specimens, and the volume/quantity. 
  • Other supporting documents as requested by the secretariat to complete your licence application. 

3. Complete and submit your application (including all supporting documents) through the Sabah Biodiversity Access and Export Licence Application System (SaBAES) (https://sabaes.sabah.gov.my/login).

4. Incomplete applications will not be accepted and will be rejected.

Supporting documents checklist

  1. Letter of support from your local collaborator mentioning the following: 

         1.2 Supports your intention to export the materials; 

         1.3 Justification on why the research could not be conducted in Sabah; 

         1.4 List of samples/specimens, and the volume/quantity. 

2. Other supporting documents as requested by the secretariat to complete your licence application.

Terms & Conditions

1. The Export Licence is valid for one (1) year. 

2. You can only perform research analysis stated within the Export Licence. 

3. You can only export the materials to the location listed within the Export Licence.; 

4. You shall comply with other written laws governing the export of the material from Sabah; 

5. Application for patent or other intellectual property rights to the relevant authority in or outside Malaysia must first be subject to gaining prior written consent from the Sabah Biodiversity Council; 

6. Once the research is completed, you must return the exported materials to your local collaborator.
